1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Lip Smackers Delivery Network ("we," "our," or "us") governing your access to and use of our website and delivery driver services.

By accessing or using our services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use our services.

2. Eligibility

To be eligible to use our services as a delivery driver, you must:

  • Be at least 18 years of age
  • Possess a valid driver's license
  • Own or have access to a reliable vehicle
  • Have valid auto insurance that meets state minimum requirements
  • Have a clean driving record
  • Pass our background check
  • Have a compatible smartphone

3. Independent Contractor Status

As a delivery driver for Lip Smackers Delivery Network, you acknowledge and agree that you are an independent contractcontractor and not an employee of Lip Smackers Delivery Network. This means:

  • You are free to determine when, where, and how long you work
  • You are responsible for all expenses related to your deliveries, including vehicle maintenance, fuel, insurance, and taxes
  • You are not entitled to employee benefits such as health insurance, paid time off, or workers' compensation
  • You are responsible for reporting and paying all applicable taxes on income earned through our platform

4. Driver Responsibilities

As a delivery driver, you agree to:

  • Maintain your vehicle in safe and good operating condition
  • Maintain valid auto insurance and a valid driver's license
  • Comply with all applicable laws, including traffic laws and food handling regulations
  • Deliver orders in a timely and professional manner
  • Treat customers, restaurant staff, and Lip Smackers Delivery Network personnel with respect
  • Not consume alcohol or drugs before or during your delivery shifts
  • Not discriminate against any customer based on race, color, religion, national origin, disability, sexual orientation, gender, gender identity, or any other legally protected classification

5. Payment Terms

You will receive payment for completed deliveries according to our payment structure, which may include base pay, incentives, and customer tips. Payment details will be provided during the onboarding process and may be updated from time to time.

You acknowledge that:

  • Payments will be made to your designated bank account on a weekly basis
  • You are entitled to 100% of customer tips
  • Payment rates may vary based on distance, time, and other factors
  • We may make adjustments to payments in cases of customer refunds, errors, or fraud

6. Termination

Either you or Lip Smackers Delivery Network may terminate this agreement at any time, with or without cause, effective immediately. Upon termination:

  • You will no longer have access to our delivery platform
  • You will receive payment for all completed deliveries prior to termination
  • You must return any Lip Smackers Delivery Network property in your possession

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LIP SMACKERS DELIVERY NETWORK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES
  • ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES
  • ANY CONTENT OBTAINED FROM THE SERVICES
  • UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT

8. Dispute Resolution

Any dispute arising from or relating to these Terms or your use of our services shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules. The arbitration shall be conducted in [Your City, State], and judgment on the arbitration award may be entered in any court having jurisdiction thereof.

9. Changes to Terms
